A Former Federal Prosecutor Who Now Fights For Defendants

Bathroom break leads to drug charges for Florida woman

An overly long visit to a convenience store restroom led to felony drug trafficking charges for a Florida woman on April 29 according to a report from the Santa Rosa County Sheriff' Office. The 22-year-old Gulf Breeze resident has been charged with first-degree felony counts of trafficking in methamphetamine and heroin and five third-degree misdemeanor counts of drug possession.

Deputies were dispatched to a convenience store on Breeze Parkway in Gulf Breeze after workers at the store had reported that two female customers were behaving strangely. The workers told deputies that the two women appeared to be drunk or under the influence of drugs and had locked themselves in a bathroom for over an hour. Deputies say that the women were still inside the store when they arrived at the scene.

Deputies claim that the woman seemed disorientated and showed signs of recent drug use, and they claim that she admitted to them that she was carrying illegal drugs. A subsequent search of her person is sad to have led to the discovery of 69 grams of marijuana, 31, oxycodone pills, 123 Xanax bars, 34 MDMA pills, 5.1 grams of cocaine, 35.7 grams of methamphetamine and 6.2 grams of heroin along with several items of alleged drug paraphernalia.

Police officers who conduct warrantless searches must have reason to believe that evidence of a crime will be discovered, and admissions made by suspects are generally enough to provide them with probable cause. Experienced criminal defense attorneys may recommend that those charged with drug trafficking remain silent until they have spoken with an attorney even when they believe that the evidence against them is overwhelming.
