Probation check leads to drug charges for Florida man

A 33-year-old Florida man is facing a raft of drug charges after a routine probation check on April 17 allegedly led to the discovery of significant quantities of marijuana, cocaine and methylenedioxymethamphetamine, which is more commonly known as MDMA or ecstasy. Reports indicate that the man was transported to a Polk County detention facility after being booked and has been charged with possession of more than 10 grams of MDMA, possessing prescription drugs without a valid prescription and possessing cocaine and marijuana with the intent to distribute. The man also faces more severe sanctions because the drugs were allegedly discovered within 1,000 feet of a place of worship.

According to media reports, officers from the Winter Haven Police Department accompanied a Florida probation officer to the man's residence for a routine security check at approximately 8:30 a.m. Upon entering the residence, officers claim to have noticed a bag containing white powder and a set of digital scales on a counter. A brief inspection of the home is said to have also led to the discovery of $3,121 in cash.

Police officers say that they were able to obtain a search warrant based on these discoveries. A more thorough inspection of the residence allegedly led to the recovery of more than 450 grams of cocaine, almost 40 ounces of marijuana, 47.7 grams of the prescription sedative Xanax, 14.2 grams of MDMA and 1.1 grams of the narcotic pain reliever tapentadol.

The Fourth Amendment provides protections against unreasonable search and seizure, but police officers are not required to obtain search warrants when evidence of criminal activity is in plain sight. Criminal defense attorneys with experience in cases involving drug possession charges may recommend that their clients bear this in mind and not consent to a search without first speaking with counsel.
